General Purchase Terms

These General Purchase Terms (hereinafter referred to as “GPT”) are governed by the provisions of Act No. 89/2012 Coll., civil code and Act No. 634/1992 Coll., on consumer protection, as amended.

GPT are issued by the company Musée Grévin Prague s.r.o., ID No. 291 28 285, with its registered seat at Celetná 596/15, Staré Město, 110 00 Prague 1, registered in the Commercial Register administered by the Municipal Court in Prague, Section C, Insert 202065 which runs the wax museum (hereinafter referred to as the “MUSEUM GREVIN”).

The provisions of GPT are an integral part of the ticket purchase agreement.

The subject of these GPT is a regulation of the contractual relations between a person entering into the contractual relationship with the MUSEUM GREVIN (hereinafter referred to as the “client”) and the MUSEUM GREVIN in the process of buying of tickets to the Museum Grévin (hereinafter referred to as the “entertainment area”), fulfilment of relating services offered in the MUSEUM GREVIN brochure or by means of distance communication.

MUSEUM GREVIN is the only person entitled to receive and respond to all client´s complaints concerning the interpretation or fulfilment of these terms. MUSEUM GREVIN is not responsible for non-compliance with the obligations arising from these terms, if the violation occurred as a result of unforeseen events, force majeure (vis maior) or offence caused by a person not having to do with the organization, tour, nor the services provided on this occasion.

An order of the entry and/or the services as well as purchasing of the ticket at the ticket offices involves the acceptation of these GPT and special conditions of the MUSEUM GREVIN with which the client can familiarize on the back side of the orders and invoices issued by the Reservation system of MUSEUM GREVIN or web site www.grevin-praha.com and that are effective on the day of making of the order or purchase, unless specific provisions provide otherwise.

It is expressly laid down that the information stated in the MUSEUM GREVIN brochure can be changed and the client will be familiarized with the changes before the confirmation of the order except for the changes relating to the performances, shops, events, restaurants and additional services that may be closed, modified, postponed or cancelled without prior notice. The subject of these terms is to familiarize the client with the description of the entertainment area and services offered by the MUSEUM GREVIN and especially with the prices, payment methods, terms of withdrawal of the agreement or changes of the agreement. These terms can be amended in case of the events for particular products or during certain periods of the year. For these events the special sales conditions are specified in the brochure or materials issued particularly for this occasion.

I – COMMON TERMS FOR PURCHASE OF THE TICKETS INTO THE ENTERTAINMENT AREA OF MUSEUM GREVIN

All prices are stated in Czech Crowns, eventually in foreign currency and set taking into account appropriate VAT on the date of sending of the order. After the date of sending of the order by the client and its proper confirmation by the MUSEUM GREVIN according to the provisions contained in these terms or buying of an individual ticket at the ticket office of Museum Grévin or via internet or third parties with which the MUSEUM GREVIN entered into the distribution contract the price of the ticket cannot be changed.

Notwithstanding the above mentioned in case of a change of the amount of taxes the MUSEUM GREVIN is entitled at any time to change the prices. The prices include the one-time entry to the entertainment area of Museum Grévin; the prices do not include any other expenses of private character. If the tariff terms are bound to the age of the child or children, the age is judged on the day of a visit. A document with a date of birth can be required; in case of non-presentation of the document the adult tariff will be charged.

The client agrees to the use of the means of distance communication in the course of entering into the ticket purchase agreement through the Reservation system of MUSEUM GREVIN. The costs incurred by the client using the means of distance communication in connection with the entering into the ticket purchase agreement (costs of internet connection) are borne by the client and these costs do not differ from the basic rate.

The client can pay the price of the tickets and eventual costs connected with their delivery to the MUSEUM GREVIN in the following ways:

  • in cash at the ticket offices of the MUSEUM GREVIN, unless stated below otherwise.
  • in cash on delivery at the place determined by the client in the order (in case of sending of tickets)
  • via bank transfer to the account of the MUSEUM GREVIN which details will be communicated to the client by the MUSEUM GREVIN
  • by credit card payment
  • by coupons, if the MUSEUM GREVIN will accept them.
  • on-line by payment card in case of online purchase of the tickets (e-tickets).

II – SPECIAL TERMS FOR PURCHASE OF THE INDIVIDUAL TICKETS INTO THE ENTERTAINMENT AREA OF THE MUSEUM GREVIN

Purchase of the tickets in the number up 19 tickets incl. within a single purchase can be done at the ticket offices of Museum Grévin, via internet or on the following web site: www.grevin-praha.com, or through third parties that entered into the distribution contract with the Museum Grévin. Methods and special sales terms specific to online purchase of the tickets (e-tickets) are described in detail on the above mentioned web site.

II. 1 – Undated tickets

Unless stated otherwise, the undated tickets are valid for one year from the date when they were purchased and cannot be returned. The period of validity is marked on the undated tickets. Purchasing of the undated ticket does not guarantee the entry into the Museum Grévin during the days of high attendance. For ensuring of the entry the holder of undated ticket is required to make a prior reservation of the date (day and time) of his visit in the Reservation system of Museum Grévin or on the email address: sales.praha@grevin.com or by phone: +420 226 776 776

II.2 - Withdrawal of the ticket purchase agreement by the client - consumer

The client is not entitled to withdraw from the dated ticket purchase agreement entered into by means of distance communication pursuant to Section 1837 par. j) of the Act No. 89/2012 Coll., civil code.

The client – consumer is entitled to withdraw from the undated ticket purchase agreement entered into by means of distance communication without giving any reason within the period of 14 days. The period according to the previous sentence runs from the date of receipt of the tickets. For the compliance with the period it is sufficient that the client - consumer sends the withdrawal of the agreement before elapse of the period.

For the purposes of exercise of the right to withdraw from the agreement the client - consumer has to inform the MUSEUM GREVIN about its withdrawal on the address mentioned in subsection IV.11. GPT below and on the email address: sales.praha@grevin.com in a form of unilateral legal act (e.g. by a letter sent through postal service provider, fax or email). The client – consumer may use a model form for withdrawal in the attachment, but it is not the obligation of the client – consumer.

If the client - consumer withdraws from the agreement, the client - consumer without undue delay at the latest within 14 days from the withdrawal of the agreement sends back or hands over on the address of Celetná 596/15, Praha 1, P.C. 110 00 to the MUSEUM GREVIN the tickets that the client – consumer received. The client - consumer bears the direct costs connected with returning of the tickets. The obligation to send the ticket back does not apply to e-tickets which become invalid upon delivery of the withdrawal to MUSEUM GREVIN. If the client - consumer withdraws from the agreement, the MUSEUM GREVIN shall return without undue delay at the latest within 14 days from the withdrawal of the agreement and return of the tickets, all the assets including costs for delivery that the MUSEUM GREVIN has accepted on the grounds of the agreement using the same method. Other method can be used for return of the assets only with the consent of the client - consumer and if such a method does not result in the additional costs for the client - consumer. If the client - consumer chose other than the cheapest method of delivery of the tickets offered by the MUSEUM GREVIN, the MUSEUM GREVIN shall return to the client - consumer the costs for delivery of the tickets in the amount corresponding to the cheapest offered way of delivery of the tickets.

The MUSEUM GREVIN is not obliged to return accepted assets to the client - consumer before the client - consumer hands over the tickets or proves that the tickets were sent to the MUSEUM GREVIN.

III – SPECIAL TERMS FOR PURCHASE OF GROUP TICKETS

III.1 – Common terms for all group orders

III.1.1 – Definition of a group order

Unless stated or specified in brochures otherwise as the group order is considered every order of at least 10 (ten) tickets within a single order.

III. 1.2 – Purchase terms

The group orders can be placed through the Reservation system of the MUSEUM GREVIN on the address of sales.praha@grevin.com. Each of the group orders shall contain the number of tickets (adults and children under 14 years). The agreement is entered into by proper confirmation of the group order by the Reservation service of the MUSEUM GREVIN. In the event of despatching of the tickets in advance is required a payment of 100 % (one hundred percent) of the price of ordered tickets. The tickets are dispatched by “delivery tracking” together with an invoice as soon as the payment for the tickets is credited to the account of the MUSEUM GREVIN.

At the client´s request the tickets can be sent through DHL/UPS. The postage is always charged to the client according to the lump fee that applies on the day of sending of the tickets and that is stated in the business brochure. In the event that for the reasons on the side of the client the postal item has to be delivered repeatedly or by using of a way of delivery other than stated in the order, the client is obliged to pay to the MUSEUM GREVIN the costs connected with a repeated delivery of the postal item, respectively costs connected with the other delivery method.

In case that the group (i.e. 10 and more people) appears directly at the ticket offices of the Museum Grévin without a prior reservation of the entry date in the case of undated tickets or orders of undated tickets through the Reservation service of the MUSEUM GREVIN, the admission to the Museum Grévin is not guaranteed.

III.1.3 – Due date

The invoices issued by the MUSEUM GREVIN are due in 14 days from the date of issue.

III.2 – Special terms for purchase of dated tickets

III.2.1 – Tariffs of dated tickets

The tariffs of the dated tickets for groups apply to the purchase of the tickets into the entertainment area of MUSEUM GREVIN for groups of at least 10 (ten) paying persons (children and adults together) for one entry on a determined day. The tariffs of the dated tickets for school groups apply to each purchase of tickets into the entertainment area of MUSEUM GREVIN for groups of at least 20 (twenty) paying children for one entry on a determined day.

III.2.2 – Terms of purchase of dated tickets

The agreement is entered into by a confirmation of the order by the Reservation service of the MUSEUM GREVIN. The confirmation by the Reservation service of the MUSEUM GREVIN will be formalized by issuing of a pro forma invoice replacing the agreement that will be sent to the client. The client is obliged to return the duly signed pro forma invoice and in accordance with the instructions (especially within the set period) on the pro forma invoice to pay the total price of the ordered tickets. The terms (III.1.2) are applicable to the dispatch of the dated tickets in advance as well as to the purchase of the tickets to the entertainment area of the MUSEUM GREVIN.

After the confirmation of the order by the Reservation service of the MUSEUM GREVIN, i.e. entering into the purchase agreement, the client is not entitled to change or cancel the order (i.e. return the dated tickets) except for the event in subsec. III.2.3 GPT below.

III.2.3 – Change on the side of the client

A request of a change of the date relating to the ticket already invoiced must be done in writing on the address of the seat of the MUSEUM GREVIN or through internet on the email address of sales.praha@grevin.com. The agreement on a change of the date is entered into on the ground of the written confirmation or confirmation sent on the email address of the sender by the Reservation service of the MUSEUM GREVIN.

In case of a client´s request of a change of the date relating to the ticket already invoiced, the MUSEUM GREVIN charges a processing fee in the amount of 20 % of the price of each ticket including VAT. The processing fee is directly included in the invoice issued by the Reservation service of the MUSEUM GREVIN. When the change of the date is duly accepted by the Reservation service of the MUSEUM GREVIN, the system generates a modified price and the invoice will also be changed.

III.3 – Special terms for purchase of the undated tickets

III.3.1 – Determination of tariff for purchase of the undated tickets

Tariffs for purchase of the undated tickets apply to every purchase of the tickets into the entertainment area of the MUSEUM GREVIN for a groups of at least 10 (ten) paying persons (adults and children together). The undated tickets are valid for one year from the date when they were purchased. They are usable individually. Purchase of undated tickets does not guarantee the entry into the MUSEUM GREVIN during the days of high attendance.

III.3.2 – Terms of purchase of the undated tickets

The client can order minimum of 10 (ten) tickets for individual use only through the Reservation service of the MUSEUM GREVIN. The order is binding upon the confirmation by the Reservation service of the MUSEUM GREVIN. After the crediting of the total amount of the order on the account of the MUSEUM GREVIN the tickets will be sent by tracked delivery to the client (terms of (III.1.2) apply to the purchase of the tickets into the entertainment area of the MUSEUM GREVIN).

After the confirmation of the order by the Reservation service of the MUSEUM GREVIN, i.e. entering into the purchase agreement, except for the possibility of withdrawal of the agreement pursuant to II.2 GPT, the client is not entitled to change or cancel the order.

III.3.3 – Reservation of the date of entry for undated tickets

The client for ensuring of the entry into the Museum Grévin on a specific date (date and hour) on the grounds of the undated tickets is required to make a reservation of the date on the address of: sales.praha@grevin.com at least two days before the required date of entry.

If the date of entry required by the client suits regarding the capacity reasons the MUSEUM GREVIN sends to the client a confirmation of reservation of the date. Otherwise the MUSEUM GREVIN shall communicate to the client alternative dates of entry. By confirmation of the reservation of the date the reservation is binding and may be changed only with a consent of the MUSEUM GREVIN.

IV – MISCELLANEOUS PROVISIONS

IV.1 – Default

In case of default in payment by the client, the client is obliged to pay to the MUSEUM GREVIN the interest from the outstanding amount in the amount set by the governmental regulation pursuant to Section 1970 of the civil code.

IV.2 – Intellectual property rights

The client does not acquire any intellectual property rights, particularly copyrights, industrial property rights, nor any licence or permission for use of the names, characters, symbols, logos, brands and other feature owned by the MUSEUM GREVIN is granted.

IV.3 – Force majeure

The management of the MUSEUM GREVIN reserves the right to cancel any reservation in case of force majeure or unforeseeable events that will force the management to do so. An exemplary list of the events is: strike, fire, water accident, inaccessibility, epidemics, decisions of state authorities, etc. In such a case the MUSEUM GREVIN is entitled to offer a new date of the visit at the Museum Grévin.

IV.4 – Liability

The MUSEUM GREVIN is not liable for any damages caused by the circumstances of a specific nature, especially: fire and/or theft of the items brought into the Museum Grévin that were not dropped off at the cloakrooms.

Each visitor is responsible for the damages caused by the visitor during the visit of the entertainment area of the MUSEUM GREVIN. The MUSEUM GREVIN decides on the conditions of operation and maintenance of the MUSEUM GREVIN, (i) determination of the opening days and hours of the MUSEUM GREVIN and the attractions that it offers, (ii) the maintenance, repair, renewal of all equipment which is owned or used by the MUSEUM GREVIN, as well as (iii) the application of laws and regulations regarding a health, safety and public presentation of the attractions, shows and services provided to the customers by the MUSEUM GREVIN. In particular, the MUSEUM GREVIN is entitled to decide on closing of the whole or part of the MUSEUM GREVIN for a public and suspend of the provision of all or some of the offered services such as restaurant services for a period that the MUSEUM GREVIN deems necessary, especially for the reasons of acts related to the safety or health of the visitors, maintenance, repairs, renovation, reconstruction of the whole or part of the equipment of the MUSEUM GREVIN and as well for the reasons of a bad weather or public order, etc. without being responsible and the client claiming compensation of damage on the basis of the above mentioned.

It is expressly stated that malfunction of a part of the exhibition is not a reason for returning of the admission fee.

IV.5 – Visitor Regulations

Each visitor has to comply with the Visitor Regulations of the MUSEUM GREVIN which is available at the cash desk and posted at the entrance. Security staff of the MUSEUM GREVIN is entitled to take out anyone who violates the Visitor Regulations of the MUSEUM GREVIN. The visitors took out on the basis of the above mentioned do not have a right to claim admission fee back.

IV.6 – Complaint

The purchased ticket is not exchangeable or returnable, unless stated otherwise. In case of damage, destruction, loss or theft of the ticket the ticket will not be replaced by a new one nor the compensation be granted to the client.

The client has especially the right to notify defects of quantity of the tickets in conflict with the client´s order.

The complaints of fulfilment provided by the MUSEUM GREVIN shall be made in writing via internet and sent to the customer service of the MUSEUM GREVIN on the address mentioned in subsection IV.11. GPT below, email address: sales.praha@grevin.com without undue delay after the visit of the MUSEUM GREVIN. The complaints may also be submitted via web site of the MUSEUM GREVIN or complaint forms that are available to the visitors on the “Group desk”. We recommend to the client to support the existence and content of the contractual relationship in an appropriate manner (e.g. by providing of the ticket, invoice, confirmations, vouchers, etc.).

The MUSEUM GREVIN or its authorized employee shall decide on the complaint immediately and in complicated cases within 3 working days. This period does not include the time limit reasonable according to the type of the product or service required for expert assessment of the defect. Complaints including the removal of the defect must be handled without undue delay at the latest within 30 days from the date of notification of the complaint, unless it is agreed with the client on the longer period.

IV.7 – Out-of-court consumers´ dispute resolution

The MUSEUM GREVIN hereby informs the client – consumer about its right to initiate out-of-court proceedings in the matter of consumer dispute arising from the purchase agreement entered into with the MUSEUM GREVIN at the latest within 1 year from the day when the consumer exercised its right which is the issue of the dispute at the MUSEUM GREVIN for the first time. The competent body for out-of-court consumers´ dispute resolution arising from the purchase agreement entered into between the MUSEUM GREVIN and the client – consumer is Česká obchodní inspekce (the Czech Trade Inspection Authority).

The rules laid down by the Czech Trade Inspection Authority which governs the procedure of out-of-court consumers´ dispute resolution as well as the form for initiation of proceedings are accessible to the client – consumer on the Czech Trade Inspection Authority websites: adr.coi.cz or www.coi.cz.

IV.8 - Personal data protection

The MUSEUM GREVIN in accordance with the Act No. 101/2000 Sb., on personal data protection, as amended (hereinafter referred to as the “PDPA”) processes personal data of the clients who provided these data during the reservation or purchase of the tickets into the entertainment area of the MUSEUM GREVIN, in the scope of: name surname, address, email address, phone number for the purposes of fulfilment of the contract of which the parties are the clients or negotiations on entering into or amendment of the contract made upon a request of the client. The personal data are processed without the consent of the data subject in accordance with Section 5 subse. 2 par. b) PDPA.

The MUSEUM GREVIN further processes the personal data of the clients in the scope of the name, surname and address for the purpose of offering business opportunities or services to the clients also without the consent of the clients according to Section 5 subsec. 5 PDPA. Provided that if the client expresses in writing its disapproval, the administrator is not allowed to further process the data.

By completing a questionnaire (after completion of purchase) on the web site www.grevin-praha.com the client gives its consent to MUSEUM GREVIN with processing of its email address for the purposes of clients satisfaction survey, market survey and improvement of the quality of the services provided by MUSEUM GREVIN and with using of its email address for the purposes of sending of commercial communications through electronic devices pursuant to Act No. 480/2004 Coll., on certain information society services for the indefinite period. Competing a questionnaire, resp. providing of personal data is voluntary. The client is entitled to withdraw its consent by a notice send on the address of seat of MUSEUM GREVIN or to the email address info.praha@grevin.com. Consent with sending of commercial communications may also be withdrawn on the address determined within the individual commercial communication.

The administrator and processor of the personal data is the MUSEUM GREVIN. The personal data are processed automatically in electronic form.

There will be no other recipients of the personal data processed by the MUSEUM GREVIN. Providing of the personal data is voluntary.

The MUSEUM GREVIN hereby informs the clients about their right of access to personal data, the right to have their personal data rectified as well as other rights provided for in Section 21 PDPA, especially if the client finds or presumes that the administrator or the processor is carrying out processing of its personal data which is in contradiction with the protection of private and personal life of the client or in contradiction with the law, in particular if the personal data are inaccurate regarding the purpose of their processing, the client may ask the administrator or processor for explanation; require form the administrator or processor to remedy the arisen state of affairs, especially by blocking, correction, supplementing or liquidation of personal data.

IV.9 – Other rights and obligations

The MUSEUM GREVIN is not in relation to the client bound by any codes of conduct within the meaning of Section 1826 subsec. 1 par. c) of the Civil Code.

The MUSEUM GREVIN provides out-of-court settlement of the complaints of the consumers on the address of: info.praha@grevin.com. The MUSEUM GREVIN shall send the information on the settlement of the complaint of the client on the email address of the client.

The MUSEUM GREVIN is entitled to sell the tickets and provide services on the basis of the trade licence. Trade inspections are carried out within its authority by the relevant Trade office. The supervision of the area of personal data protection is exercised by the Office for Personal Data Protection. The Czech Trade Inspection Authority exercises within a specified scope besides other things a supervision of compliance with the Act No. 634/1992 Coll., on consumer protection, as amended.

IV. 10 – Disputes

These General Purchase Terms are governed in terms of the interpretation and as well as use by the Czech law. If the dispute is not settled amicably, the courts of the Czech Republic are competent.

Pursuant to the Act on Registration of Sales, the salesperson is obliged to issue a receipt to the buyer. Sales must be registered to the tax authority online; in case of a technical failure this must be done within 48 hours.
